By creating an account, pressing “Accept” or using the Service, the user declares that they have read, understood and accepted these Terms, which together with the Privacy Policy (published on the Site) constitute the agreement between the user and the company. If you do not agree, you must not use the Service.

Use of the Applications through Apple App Store or Google Play is also subject to the terms and conditions of those platforms.

2. Requirements of use and parental authority

The Service is designed exclusively for family safety and the parental supervision of minors. Only persons over 18 years of age with full legal capacity may contract the Service.

  • Account holder: the adult (father, mother or legal guardian) who contracts the Service and configures the supervision.

  • Parental authority: the user may only use the Service in respect of minors and devices over which they hold parental authority, legal guardianship or other valid legal authority. It is prohibited to supervise any person or device without the legally required authority or consent.

  • Responsibility for lawful use: the user is responsible for ensuring that their use of the Service (location, content supervision, SOS and other features) complies with the legislation applicable in their jurisdiction, including privacy, data protection, telecommunications, consumer and child protection laws.

The processing of minors' personal data requires the verifiable consent of the holder of parental authority or guardianship, in accordance with Article 8 of the GDPR and the applicable age of digital consent (14 years in Spain), as described in the Privacy Policy.

3. Purpose and licence of use

The company grants the user a limited, non-exclusive, non-transferable, non-sublicensable and revocable licence to: (a) access and use the Service for personal, non-commercial purposes; (b) download and install the Applications on compatible devices; and (c) use the features included in the subscription plan contracted. All rights not expressly granted are reserved to the company.

4. Description of the Service

The Service comprises the Guardian Bubble application, installed on the adult's device, and the Guardian Bubble Kids application, installed on the minor's device. The devices are linked by means of a pairing code generated in the adult's application. The features available depend on the plan contracted (section 5) and on the platform of the minor's device.

4.1. Location and zones

  • Real-time location of the minor's device and display on a map.

  • Location and route history (depending on plan), retained for a maximum of 30 days and deleted automatically.

  • Safe zones and alert zones (“Red Zone”) with entry and exit notifications.

  • Arrival alerts (“No Show”): a notice if the minor does not arrive at a place by a configured time.

Location accuracy depends on external factors (coverage, GPS, connection). The location shown corresponds to the minor's device, not necessarily to the person (for example, if the minor forgets or lends their device).

4.2. Emergencies (SOS)

  • SOS button: the minor can trigger an emergency alert that is sent to the adult.

  • Live audio during SOS (depending on plan): when the minor activates the SOS, a temporary audio transmission is established from the minor's device to the adult's device, to assist in the emergency. It is not designed for continuous listening, covert surveillance or the recording of conversations, and is not recorded by default.

  • Critical Alerts (iOS): emergency notifications on iOS which, where available, authorised by Apple, enabled by the user and permitted by the device settings, may sound even when the adult's device is in silent mode.

4.3. Device usage control

  • Screen time: usage monitoring and daily limits; schedule programming (depending on plan).

  • App blocking and device locking (“Superlock”), subject to technical availability, operating system, permissions granted and platform policies.

  • Web filtering and blocking of inappropriate domains.

  • App usage history (depending on plan).

  • Low battery and inactive device alerts.

  • Safe Calls and audible signals (“Beeps”) subject to the limits of the plan contracted.

4.4. AI content detection (Android only)

On compatible Android devices of the minor, and only if the adult activates this feature, the minor's application analyses the content displayed on screen (text and images) to detect risk categories (for example: sexual content, bullying, drugs and alcohol, violence and threats, self-harm, hate speech and concealment signals) and notify the adult. The analysed content is not stored; the analysis is carried out in the European Union, in accordance with the Privacy Policy.

Important: this feature does not exist on iOS due to technical restrictions of the platform. On the minor's iOS devices, only web filtering and the other features not based on content analysis are available.

4.5. Nature of the Service: a support tool

The Service is a tool to support parental supervision and does not replace it. AI content detection is probabilistic in nature: the company does not guarantee the detection of all risk content or situations, nor the absence of false positives. Alerts are for information purposes and the assessment and any action always remain the responsibility of the adult. Nor does the Service guarantee the prevention of incidents, accidents or harm to the minor.

The user undertakes not to rely on the Service as the sole means of protecting the minor and to maintain such parental supervision as is appropriate.

4.6. Technical dependence, circumvention and platform limitations

The effectiveness of the Service depends on the Applications remaining installed, with the necessary permissions active and with connectivity on the devices. The company does not guarantee that the minor cannot circumvent, deactivate or uninstall the supervision, blocking or limit features, and is not liable for supervision failures arising from such circumvention, from the deactivation of permissions, from lack of connectivity or from the device being switched off.

The features available depend on the capabilities and policies of the platforms (Android and iOS). Operating system updates or changes in Apple's or Google's policies may affect, limit or prevent certain features without this constituting a breach by the company, which will adapt the Service within a reasonable period. If a change substantially reduces the essential features contracted, section 11 shall apply.

Use of the Applications may consume mobile data; the operator's connectivity charges are borne by the user.

5. Subscription plans, prices and free trial

5.1. Plans and prices

The Service is offered through two subscription plans, Protect and Premium, with monthly or annual payment options, identical on Android and iOS.

Prices: the selling prices in force at any given time are displayed clearly and visibly in the application and on the Apple App Store or Google Play purchase page before the purchase is confirmed, and include applicable taxes. The company may offer promotional or launch prices for limited periods; once the promotional period ends, the ordinary price in force shown at the time of purchase or renewal will apply.

Any change to the price of an active subscription will be communicated to the user with reasonable notice and will take effect from the next renewal; it will be managed and applied through the mechanisms of the relevant purchase platform (Apple App Store or Google Play). If the user does not agree with the new price, they may cancel the subscription before the renewal takes effect.

5.2. Features and limits of each plan

The features, limits, prices, subscription options and add-ons available in each plan are displayed clearly before purchase in the application, on the Site and on Apple App Store or Google Play, as applicable. The commercial conditions accepted by the user at the time of purchase form part of the contract for the Service.

The availability of certain features may vary depending on the plan contracted, the platform used, the operating system, the permissions granted and Apple's or Google's policies. The number of minors supervised simultaneously (active slots), of adults and of devices included depends on the plan contracted; creating a new minor profile requires a free active slot.

5.3. Add-ons

The Service may offer optional paid add-ons, such as additional minor-profile or device capacity. The price, scope and limits of each add-on are displayed clearly before purchase in the application and in the relevant store. Add-ons only extend capacity and do not alter the features included in the plan contracted, unless expressly indicated.

5.4. 14-day free trial

  • All new users enjoy a 14-day free trial, on both platforms.

  • During the trial, the user has access to all features of the Premium plan, regardless of the plan selected.

  • One trial per customer: it is not possible to obtain a second trial by switching plan or product.

  • Prior notice: the user will receive a reminder before the trial ends. If they do not cancel before the end of the trial period, the selected subscription will be activated and charged through the relevant application store.

5.5. Billing, renewal and cancellation

Contracting and payment take place exclusively through Apple App Store or Google Play. Subscriptions renew automatically at the end of each period (monthly or annual) unless cancelled beforehand through the settings of the relevant store. Voluntary cancellation maintains access until the end of the period already paid. Refunds are governed by the policies of the store through which the purchase was made, without prejudice to the rights that consumer legislation grants the user.

5.6. Right of withdrawal (consumers)

If you are a consumer, you have 14 calendar days to withdraw from the contract without giving any reason. As the subscription is contracted and charged exclusively through Apple App Store or Google Play, the exercise of the right of withdrawal and the processing of refunds are governed by the terms of the store through which you contracted and are handled directly with that store: on Apple App Store, from your Apple account (Purchase History, “Report a Problem”) or by means of the withdrawal form made available by Apple; on Google Play, through Google Play's refund and withdrawal function. These Terms do not limit or exclude any right of withdrawal or refund granted to you by law or by the store.

Immediate commencement of performance. By activating the free trial or the subscription, you expressly request that performance of the Service begin immediately, during the withdrawal period, and you acknowledge and accept that, once the Service has been fully performed, you will lose the right of withdrawal in respect of the part already provided. The free trial does not generate any charge; the first charge is made only at the end of the trial period if you do not cancel beforehand, in accordance with section 5.4.

6. Plan changes, profile pausing and expiry

6.1. Plan upgrade

Plan upgrades are applied in accordance with the rules of the relevant store. After an upgrade, paused profiles and settings are reactivated automatically as they were.

6.2. Plan downgrade and add-on cancellation: pause-and-preserve rule

A minor's data is never deleted automatically. When a plan downgrade or the cancellation of an add-on takes effect (at the end of the billing cycle), the profiles or devices exceeding the new capacity are set to PAUSED status: their supervision stops, but their data is not deleted. By default, the most recently added profiles are paused first.

The data of paused profiles remains linked to the adult's account and remains subject to the retention and automatic deletion periods described in the Privacy Policy (locations: 30 days; alerts: 90 days). Premium-only settings (schedules, additional zones) are preserved inactive and restored upon upgrading again.

6.3. Switching active minors

When the number of minor profiles exceeds the plan's active slots, the adult may choose which minors are active. The switch takes effect immediately. After each switch, the ability to switch again is locked for 30 calendar days from the last switch made by the user; the application displays the exact date on which switching will again be possible. Pauses applied automatically by the system (for example, following a plan downgrade) do not consume the user's available switch.

6.4. Expiry of the subscription or trial

If the subscription or the trial ends without an active plan: all profiles and devices are set to paused status, remaining linked and preserved; the adult retains access to their account, settings and historical information in read-only mode, together with the reactivation screen; and supervision, alerts, location uploads and the execution of commands on the minor's device stop, with any active lock on that device being released.

7. User account

The user must provide true and complete information when creating their account, keep their credentials confidential and immediately notify any unauthorised use. The user is responsible for the activity carried out from their account. Accounts are not transferable.

8. Prohibited uses

It is prohibited, among other things: (a) to use the Service to supervise persons over whom the user does not hold legal authority; (b) to use it for commercial or unlawful purposes; (c) to copy, modify, decompile or reverse-engineer the software; (d) to circumvent technical protection measures or interfere with the operation of the Service; (e) to introduce malicious software; (f) to collect other users' personal data; (g) to impersonate third parties.

8.1. Prohibition of child sexual abuse and exploitation

The Service is designed for the protection of minors. Its use for child sexual abuse or exploitation is strictly prohibited. If you detect any use contrary to this prohibition, contact admin@guardianbubble.com. You may also report child sexual abuse material (CSAM) to the INHOPE network (https://www.inhope.org/) or to law enforcement authorities. The company will immediately remove such content, may block the offending account and will bring the facts to the attention of the competent authorities.

9. Legal notice on the SOS audio feature

The SOS audio transmission is activated only when the minor presses the emergency button, is temporary and is intended to assist in the emergency. It is not designed for continuous listening, covert surveillance or the recording of private conversations, and is not recorded by default. Use of this feature may be subject to local communications legislation; the user is responsible for using it in accordance with the law. If, during its use, the user receives information from third parties without their consent, they must refrain from keeping or disseminating it.

10. Intellectual property

The Service, the Applications, the software, designs, logos, trademarks and other content of the company are protected by intellectual and industrial property rights and belong to Parental Control Tech OÜ or its licensors. These Terms do not transfer to the user any right over them beyond the licence of use described in section 3.

11. Modifications to the Service and to the Terms

The company may update the Applications and modify features in order to improve the Service. If an update were to substantially reduce the essential features for which the user has paid, the user will be notified at least 30 days in advance and may terminate their subscription with a proportional refund of the part not enjoyed, in accordance with Directive (EU) 2019/770 on digital content and digital services.

The company may amend these Terms by publishing the updated version on the Site. Substantial changes will be communicated prominently and, where required by law, with reasonable notice.

12. Liability

We will be liable to the user for damage caused by our breach of our obligations, in accordance with the law.

Within the limits of the law: (a) the Service is provided “as is” and its availability may be affected by external factors (coverage, third-party platforms, device configuration); (b) the company does not guarantee the detection of all risks by the AI feature (section 4.5) or the absolute accuracy of the location; (c) the company is not liable for damage arising from a use of the Service contrary to these Terms or to the law, or from decisions taken by the user on the basis of the information provided by the Service; (d) the company is not liable for supervision failures arising from the circumvention, deactivation or uninstallation of the Applications by the minor (section 4.6).

To the extent permitted by applicable law, and subject to the exceptions indicated below, the company's total aggregate liability arising from or in connection with this contract shall be limited to the total amount paid by the user for the Service during the twelve (12) months prior to the event giving rise to the damage.

Mandatory exceptions. The above limitation does not apply to, or in any way affect: (i) damage arising from death or personal injury; (ii) damage caused by the company's wilful misconduct or gross negligence; (iii) the rights granted to the user by the mandatory consumer protection legislation of the user's country of habitual residence which cannot be excluded or limited by contract, including the user's rights for lack of conformity of the digital service; or (iv) any other liability which, under applicable law, cannot be excluded or limited. Nothing in these Terms excludes or limits the user's statutory rights as a consumer.

13. Data protection

The processing of the personal data of the adult, the minor and, where applicable, third parties is governed by the Privacy Policy published on the Site, which forms an integral part of these Terms. The company does not sell personal data and does not use minors' data for behavioural advertising.

14. Term and termination

These Terms remain in force for as long as the user uses the Service. The company may suspend or cancel the account in the event of a serious breach of these Terms, without prejudice to the user's consumer rights. The user may request the deletion of their account at any time; the effects on data are described in the Privacy Policy.

15. Governing law, competent courts and complaints

This contract is governed by the law of the country in which the user has their habitual residence as a consumer. As a consumer, the user in any event enjoys the protection afforded by the mandatory provisions of the law of their country of habitual residence, which no clause of these Terms may exclude or limit.

The user may bring any claim arising from this contract before the courts of their place of domicile. Parental Control Tech OÜ may only bring claims against the user before the courts of the country in which the user is domiciled.

Complaint resolution. If you have a complaint, please contact us first at admin@guardianbubble.com; we will try to resolve it. If it is not resolved, you may turn to a consumer alternative dispute resolution (ADR) entity. You can locate the competent entity and obtain free advice through the European Consumer Centres Network (ECC-Net) and, if you reside in Spain, through the European Consumer Centre Spain (CEC Spain).
